PALLET AUCTION RULES AND TERMS
Please read the following Terms and Conditions carefully. These rules apply to all Pallet Live Facebook Auctions hosted by Cape Town Live Auctions. By placing a bid, you confirm that you have read, understood and agree to be bound by these Terms and Conditions.
GENERAL TERMS
Winning a lot constitutes a legally binding contract between the Buyer, also referred to as the Bidder, and the Seller, Cape Town Live Auctions. Registration is not required to participate. However, all bidders must ensure that they understand and accept these rules before placing a bid.
ALL PALLETS ARE SOLD AS IS, VOETSTOOTS, WITH NO WARRANTIES OR GUARANTEES.
15% VAT will be added to the final bid amount. No commission is charged.
CTLA acts solely as the auction platform. Pallets are supplied and sealed by a third-party supplier. CTLA does not open, inspect, test, verify or compare pallet contents against the supplier’s list.
By bidding, the Buyer fully accepts all risks relating to the condition, quality, functionality, completeness and accuracy of pallet contents.
COLLECTION
All pallets must be collected from Epping II before 13:00 on the first Saturday following the auction. Collection is only permitted during the following times:
- Monday: 12:00 to 16:00
- Tuesday: 12:00 to 16:00
- Wednesday: 12:00 to 16:00
- Thursday: 10:00 to 16:00
- Friday: 10:00 to 15:00
- Saturday: 09:00 to 13:00
If you are unable to collect in person, you may arrange a courier. You must notify CTLA immediately after winning your first lot if a courier will be used.
The Buyer is solely responsible for arranging and paying for courier services.
PLEASE NOTE: Clients who collect pallets directly from the warehouse, excluding clients who make use of a third-party courier, are required to unpack the pallets on-site. The wooden pallet on which the goods are packed remains the property of CTLA and must be returned to the supplier.
LATE COLLECTION
Any pallets not collected by the stipulated deadline may, at the discretion of CTLA, be subject to storage fees of R250 per pallet per day and/or be resold without refunding the deposit, if applicable, to the original Buyer.
PAYMENT
Payment is strictly cash on collection, or EFT by prior arrangement with Cape Town Live Auctions. Goods will not be released until EFT payments have cleared in full.
NO CARD FACILITIES ARE AVAILABLE.
NO REFUNDS OR RETURNS
All sales are final. No refunds, exchanges or returns will be permitted under any circumstances.
This includes, but is not limited to:
- Items not working
- Missing items
- Damaged items
- Defective items
- Incorrect items
- Differences between the contents list and actual contents
- Buyer dissatisfaction with pallet contents or condition
NON-PAYMENT / DEFAULT
Failure to pay, cancellation of bids or non-collection may result in a 15% penalty fee and/or being banned from future auctions. By bidding, you agree to honour your purchase and comply with these Terms and Conditions.
BIDDING ERRORS AND AUCTIONEER DISCRETION
The Auctioneer reserves the right to reject or cancel any bid, resolve disputes between bidders, reopen or withdraw any lot and correct any errors in bidding at their sole discretion.
Bids placed in error remain the responsibility of the bidder.
DEPOSITS
The Auctioneer reserves the right to request a deposit at any time during the auction. Once a bidder’s total exceeds an amount determined at the discretion of the Auctioneer, a minimum deposit may be required immediately. The deposit amount will be decided by the Auctioneer.
Failure to pay the deposit when requested will result in disqualification from bidding. If goods are not paid for or collected by the required deadline, the deposit will be forfeited.
PALLET CONTENTS DISCLAIMER
Pallets are supplied to CTLA by a third-party supplier. Pallets are sealed by the supplier and the supplier provides CTLA with a contents list for each pallet.
CTLA does not inspect the pallets and does not compare the pallet contents with the list provided. CTLA therefore makes no representations or warranties regarding the completeness or correctness of such lists.
CTLA shall not be held liable for any discrepancies, shortages, omissions or variations between the listed contents and the actual contents of the pallet.
CTLA cannot guarantee that all listed items are present, functional, complete or in any specific condition. Variations, substitutions, shortages and defects may occur.
STOCK CONDITION DISCLOSURE
The pallet contents list will clearly indicate whether the items are classified as good stock, used goods or defective stock, as provided by the supplier. It is the sole responsibility of the bidder to review and understand this classification before placing any bids.
By placing a bid, the Buyer acknowledges that they are fully aware of the stock condition and accepts the pallet on that basis. CTLA shall not be held liable for any misunderstanding or failure by the Buyer to verify the condition of the stock before bidding.
The classification is provided as a guideline only and is based on information supplied by the third-party supplier. Discrepancies may occur, including defective items being included in pallets classified as good stock.
Even pallets classified as “good stock” may contain defective, damaged, incomplete, used, customer-returned or non-functioning items.
HOW TO BID
Post your bid in the comments and clearly indicate the Lot Number. The Auctioneer will conduct a countdown. The highest bid at the end of the countdown wins the lot.
Winners must immediately send a WhatsApp with the following details:
- Name and surname
- Contact number
- Collection date and time
